RELEASE LANGUAGE ON PROPERTY DAMAGE CHECKS AND SETTLEMENTS

On property damage settlement checks watch for the language put on the back of the check that the check was for full settlement of all claims, including bodily injuries, even though there had been no discussion or understanding that you were settling your bodily injury claims.

You can give up your rights for a claim for medical or other injuries by cashing the property damage check with that language even if the check was for the exact amount of the property damage.

Have your lawyer review your property damage settlement check to make sure you have not given up your rights to your bodily injury claims.  Often it is best to have the property damage check go directly to the repair shop if you vehicle is repairable.
